R.M. Dhariwal 100% Eou vs Union of India & Ors

Bench: 2 — Kurian

In Brief

A 100% export-oriented unit manufacturing Pan Masala, Gutkha and tobacco products sought exemption from the Plastic Wastes (Management & Handling) Rules, 2011 to use multilayered plastic sachets for packaging. The Court found the petitioner's facts were materially identical to those in Baba Global Ltd. and Harsh International, both of which had been granted exemptions. The petitioner furnished an undertaking not to sell products in the domestic Indian market. The Court allowed the writ petition, extending parity of treatment by exempting the petitioner from the Rules during the pendency of proceedings, based on strict compliance with its undertaking."
