Harwansh Kaur & Anr vs Special Area Development Authority (Counter Magnet), Gwalior & Ors

Bench: 2 — Sanjay Kumar, Alok Aradhe

In Brief

A dispute arose over agricultural land in Gwalior involving heirs of Dilip Singh (the appellants) and a development authority (the respondent). The Trial Court held the appellants owned the land through Government allotment. A subsequent suit by the respondent claiming a 2001 lease was dismissed. When the respondent filed a review petition citing new grant documents, the High Court allowed it and reopened the case. The Supreme Court held that review jurisdiction cannot reopen matters already decided on merits. The grant documents were irrelevant to the core issue of whether Government had title to transfer the land. The Court allowed the appeal and set aside the High Court's review order.
