Hemkunwar Bai sued to declare a sale deed and will fraudulent, claiming she was unlawfully dispossessed of property. The property had been mutated under the Madhya Pradesh Revenue Code to the widow of the previous owner, who then sold part via deed to two nephews and made a will for the remainder to a third nephew. The trial court found the defendants failed to prove consideration for the sale deed; however, the High Court reversed this, finding witnesses had credibly testified to the consideration. The widow's illiteracy and illness did not automatically invalidate the transaction. The Court dismissed the appeal, upholding the High Court judgment.
