Herman Break Lyngdoh was initially appointed temporarily as Section Assistant in the Public Works Department but was transferred and appointed as a Work Charge Section Assistant from October 1988. When the state undertook a regularization exercise, his name was recommended but later removed solely because his initial appointment was temporary. The Supreme Court held that the state's decision was unjustified, as the petitioner had continuously served as a Work Charge employee. The Court directed the state to reconsider his regularization from the date of his Work Charge appointment. The Court clarified that upon regularization, the petitioner would be entitled to retiral benefits and other dues despite already having retired."
