Himalaya Distilleries Limited sought to transfer a Title Suit from the District Judge Special Division in East Sikkim to the District Court in Siliguri, West Bengal. During proceedings, the petitioner filed an affidavit withdrawing all allegations made against the fifth respondent. With the respondents agreeing to the transfer, the Court granted the transfer petition. The Title Suit No. 11 of 2017 was accordingly transferred to the District Court at Siliguri, West Bengal, and all pending applications were disposed of.
