In Brief
Hind Kamgar Sanghatana, a trade union, sought to refer an industrial dispute to the Industrial Tribunal under the Industrial Disputes Act, 1947. The Tribunal dismissed the reference because the union was not recognised under the Maharashtra Recognition of Trade Unions Act, 1971, and the High Court upheld this decision. On appeal, the Supreme Court found that the High Court had not addressed the key question: what happens when a union's registration under the Trade Unions Act is cancelled. The Court remitted the matter to the High Court to decide this question and others relating to union recognition, keeping all contentions open for hearing.
