Hindustan Antibiotics Limited, a Government of India pharmaceutical undertaking, challenged the High Court's dismissal of its writ petition against Maharashtra Housing and Area Development Authority (MHADA) concerning disposal of 263.57 acres of land at Pimpri, Pune. The High Court held that the proper remedy was a civil suit, not a writ petition. The Supreme Court affirmed this approach but, invoking Order 27 Rule 5 of the Civil Procedure Code, directed the parties to pursue amicable settlement. When settlement proved impossible, the Court referred the entire dispute to Justice R.V. Raveendran as sole Arbitrator for binding resolution.
