Hindustan Antibiotics Limited, a Government undertaking manufacturing life-saving drugs, disputed with Maharashtra Housing and Area Development Authority (MHADA) over disposal of 263.57 acres of land at Pimpri, Pune following closure of a failed joint venture. The High Court dismissed the writ petition, holding that civil suit was the proper remedy. The Supreme Court held that disputes between Government entities should be resolved amicably under Order 27 Rule 5 of the Civil Procedure Code. Since amicable settlement proved impossible, the Court referred the disputes to a sole arbitrator (former Supreme Court Judge R.V. Raveendran) for final decision, disposing of the appeal.
