A real property dispute saw the High Court condone a 713-day delay in filing an appeal. However, by the time the High Court passed its condonation order on 29 September 2014, the conveyance (sale deed) had already been executed five days earlier. The Supreme Court held that since the subject matter of the appeal had become infructuous through execution of the conveyance, the High Court should not have condoned the delay. The Court set aside the High Court's condonation order and dismissed both the application and the underlying appeal, as no useful purpose would be served by entertaining it.
