The Supreme Court held that since the conveyance (property transfer) had already been executed before the High Court passed its condonation order, the appeal had become infructuous. Condoning delay was therefore unnecessary and served no practical purpose. The Supreme Court set aside the High Court's condonation order and allowed the appellant's challenge.
