ICICI Lombard General Insurance Co. Ltd vs Ajay Kumar Mohanty & Anr

Bench: 3 — D.Y. Chandrachud

In Brief

A motor accident victim who sustained fractures to the left elbow and femur claimed compensation from his insurer. The Tribunal awarded Rs. 22.85 lakhs based on assumed permanent disability, but the High Court reduced it to Rs. 12 lakhs without reasoned findings. The Supreme Court held that the doctor's admission of interpolating the disability certificate—changing "permanent" to "temporary and likely to improve"—meant the disability was temporary, not permanent. The Court awarded Rs. 9.10 lakhs: Rs. 5 lakhs for loss of income, Rs. 2 lakhs for trauma and pain, and Rs. 2.09 lakhs for medical expenses, with 9% annual interest, thereby allowing the appeal in part.
