On 26 January 2002, a fight broke out between two families over an alleged illicit relationship. The appellant attacked the complainant with an iron rod and also struck the deceased (who attempted to intervene) on the head, causing her death. The trial court convicted him under Sections 302 and 324 IPC. The High Court modified the conviction to Section 304 Part II IPC, finding a free fight existed and applying Exception 4 to Section 300 IPC. The Supreme Court upheld the High Court's judgment, rejecting arguments that related witnesses should be disbelieved and that co-accused acquittals required the appellant's acquittal. The appeal was dismissed.
