Imtiyaz Ramzan Khan vs State of Maharashtra

Bench: 2 — Uday Umesh Lalit

In Brief

Two special leave petitions against conviction and life sentence for murder under Section 302 IPC were dismissed on substantive grounds. The High Courts of Bombay and Chhattisgarh had, respectively, affirmed the convictions based on credible eye-witness testimony (first case) and after rejecting the defence of sudden fight (second case). The Supreme Court found no grounds for interference. However, the Court made a broader direction: all Legal Services Authorities and Committees must provide video conferencing facilities so that legal-aid counsel can communicate with incarcerated accused persons, thereby ensuring meaningful legal representation and advancing justice.
