Imtiyaz Ramzan Khan vs State of Maharashtra

Bench: 2 — Uday Umesh Lalit

In Brief

Two separate special leave petitions challenged High Court convictions under Section 302 IPC (murder). The first petitioner was convicted based on eyewitness testimony; the second raised a defence of sudden fight. The Supreme Court found the High Court's decisions well-reasoned and dismissed both petitions. Notably, the Court commended the Supreme Court Legal Services Committee's directive requiring video conferencing between counsel and jailed accused persons, and ordered all State Legal Services Authorities to provide such facilities in criminal cases to enhance legal aid effectiveness.
