Supreme Court of India 2020-03-06 disposed

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

This suo moto writ petition addressed the establishment of courts under the Protection of Children from Sexual Offences Act, 2012 (POCSO). The Supreme Court held that States need not mandatorily establish exclusive POCSO courts where the workload, calculated on a court-wise rather than district-wise basis, falls below 100 cases. The Court allowed flexibility, permitting States to clarify their jurisdictional arrangements and noting that POCSO cases could be handled by regular judges at both district and tehsil headquarters based on actual caseload requirements."
