In Brief
Perry Kansagra, a non-resident Indian, was convicted of civil and criminal contempt of the Supreme Court for willfully violating orders in a child custody case. The Court had granted him custody of his son Aditya on condition that he obtain a "mirror order" from Kenya courts and comply with visitation rights for the child's mother, Smriti. After taking the child to Kenya, Perry violated visitation orders, failed to disclose that Kenya courts rejected his application, and later challenged the Supreme Court's jurisdiction in Kenyan courts. Defying multiple opportunities to appear and explain himself, Perry showed no remorse. The Court sentenced him to six months simple imprisonment on each count (consecutive) plus a fine of Rs. 25 lakhs, emphasizing that the Supreme Court's contempt power is constitutional and unrestricted by statute.
