In Brief
Indian Bank appealed against a High Court order allowing a suit by A.J. Forgings Private Limited for recovery of money. The bank had undertaken to honor cheques up to Rs.6,80,000 by letter dated 1st September 1992, but when sued for larger amounts, it failed to produce the original letter, providing only a Xerox copy. The trial judge allowed the plaintiff's application for judgment on admission under CPC Order XII Rule 6, finding the bank's conduct a deliberate attempt to frustrate legal rights. The High Court Division Bench upheld this. The Supreme Court dismissed the bank's appeal, affirming that judgment on admission was properly passed.
