In Brief
The Supreme Court upheld a High Court judgment allowing recovery of money against a bank in a suit arising from the bank's undertaking to honor cheques. The bank had failed to specifically deny the undertaking in its written statement and produced only a xerox copy of the critical letter dated 1st September 1992, without the original. The Court found this constituted a deliberate attempt to frustrate the plaintiff's legal rights. The judgment on admission under Order XII Rule 6 CPC was thus properly allowed, and the Supreme Court dismissed the bank's appeal.
