Indian Hotel & Restaurant Association & Anr vs State of Maharashtra & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court addressed the implementation of the Maharashtra Prohibition of Obscene Dance in Hotels, Restaurants and Bar Rooms Act, 2016, regarding license grant conditions. The Court held that once a health department grants a license to a hotel/restaurant, no separate No Objection Certificate is required. Fire safety conditions are satisfied by obtaining a fire license. However, verification of employees' criminal antecedents by police within one week is mandatory. Structural deficiencies such as safety railings must be corrected within seven days. The competent authority must complete verifications within stipulated timeframes and grant licenses upon compliance. Four previously granted licenses that were revoked could be reinstated if grounds for revocation were addressed within one week.
