Indian Hotel & Restaurant Association & Anr vs State of Maharashtra & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Indian Hotel & Restaurant Association challenged certain conditions imposed for granting dance bar licenses under Maharashtra's 2016 Obscene Dance prohibition law. The Supreme Court held that once a hotel receives a license from the health department, no separate NOC is required from the same department. Fire licenses satisfy fire safety conditions, and certificates from the Rangbhumi Prayog Parinirikshan Mandal are obtained after, not before, license grant. Criminal background checks of employees must be completed within one week. Structural requirements (3-ft railing and 5-ft distance spacing) must be remedied within seven days. The Court directed verification of compliance and granted licenses upon satisfaction of specified conditions by the deadline set.
