In Brief
Infinity Infotech Parks leased premises to Shiva Jute Mills through an intermediary sublease. The tenant occupied the 16th floor (29,445 sq. ft.) from 2012 but paid no lease rent, maintenance, or electricity charges for over seven years. The Calcutta High Court directed restoration of electricity without requiring payment. The Supreme Court set aside this order, holding that essential services cannot be restored without payment of arrears. The Court quantified dues at Rs. 3,24,09,240 and ordered the tenant to pay Rs. 1,00,00,000 immediately with the balance in three instalments, after which electricity must be restored within 3 days."
