Iqbal Nath Sharma (D) By Lrs vs Union of India and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

An ex-serviceman employed in the Cabinet Secretariat was charged with submitting forged medical reimbursement receipts totalling over Rs. 1.5 lakh, though he received no actual payment. After two inquiries found him guilty, he was removed from service. The Supreme Court upheld the misconduct findings but modified the punishment, holding that while the conduct was serious, removal was disproportionate given his twenty years of service. The Court substituted compulsory retirement, a lesser major penalty, as more appropriate. Terminal benefits and family pension to his dependents were directed to be processed accordingly."
