Iqbal Nath Sharma (D) By Lrs vs Union of India and Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

An ex-serviceman employed in the Cabinet Secretariat submitted forged medical bill receipts and false treatment claims totaling over Rs. 1.5 lacs, though he received no actual payment. After two inquiries, he was removed from service. The Supreme Court held that while the misconduct was serious, removal was disproportionate punishment. Considering his twenty years of service and the absence of actual financial gain, the Court modified the punishment to compulsory retirement, directing that his terminal benefits and family pension be processed accordingly."
