Jagjiwan Coop. Group Housing Society Ltd. & Ors vs Lt. Governor, NCT of Delhi & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Three civil appeals challenged the land acquisition of property belonging to a cooperative housing society in Delhi. The appellants argued that the acquisition should be quashed or de-notified, relying on their status as a cooperative. The Supreme Court held that the status of being a cooperative society does not exempt land from acquisition proceedings under the Land Acquisition Act, 1894, and the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The government had already rejected de-notification prayers, and the acquisition complied with applicable law and policy. The appeals were dismissed for lack of merit."
