In Brief

A cooperative housing society challenged land acquisition proceedings initiated for a Vasant Kunj residential scheme under the Land Acquisition Act, 1894. The High Court had partially allowed the society's writ petition, quashing the invocation of section 17(4) but maintaining the acquisition notification. The Supreme Court held that the land acquisition was valid and lawful. The fact that the appellant was a cooperative society, while mentioned in Government policy, did not exempt it from the acquisition. De-notification was already rejected by the Government and could not be judicially ordered. The Court dismissed all three civil appeals as lacking merit.
