On 19 February 2004, the appellants allegedly attacked the deceased Virendra and others with weapons, resulting in Virendra's death. Convicted of murder under Section 302 IPC with life imprisonment, the appellants appealed. The Supreme Court found that while the appellants caused the death, they acted with some right to private defence—there was evidence of a prior altercation, cross-case filed against the deceased's party, and injuries sustained by the accused. The conviction was modified from Section 302 to Section 304 Part-I IPC (causing death by negligence). As the appellants had served 11½ years imprisonment, they were sentenced to time already served and released.
