Supreme Court of India 2018-02-02 remanded

Jagtar Singh & Ors vs State of Uttarakhand & Ors

Bench: 2 — Deepak Gupta

In Brief

Teja Singh's land was recorded in the name of his widow, Harbhajan Kaur, following his death. His sons Jagir and Karnail Singh objected, claiming they were in possession and sought entries in their names. The High Court found the Supervisor Qanoongo had acted without proper notice and directed deletion of all entries. The Supreme Court agreed the Supervisor violated procedure but held that deleting both parties' entries was error. The Court instead remanded the matter for the Supervisor to hear both sides and determine who holds legal possession before making the correct revenue record entries."
