Jaina Construction Company vs Oriental Insurance Company Limited & Anr

Bench: 2 — Bela M. Trivedi

In Brief

A truck owner's comprehensive insurance claim for theft was repudiated solely because the owner notified the insurer five months after the theft, despite filing an FIR immediately and the theft being confirmed genuine by police. The Court held that an insurance company cannot deny a claim on mere grounds of delay in notification when the insured promptly reported the theft to police (the primary requirement), the claim was investigated and found genuine, and no prejudice was caused to the insurer. The immediate notice obligation in theft cases applies primarily to police reporting, not the insurer; therefore, delay in insurer notification cannot be grounds for repudiation.
