Om Prakash vs Reliance General Insurance and Anr

Bench: 2 — S. Abdul Nazeer

In Brief

The appellant's truck was stolen on 23 March 2010. He lodged an FIR the next day and, after being detained by police for vehicle recovery efforts until 30 March, filed an insurance claim on 31 March—8 days later. The insurer rejected the claim citing breach of the immediate notification condition. Lower consumer forums dismissed his complaint, but the Supreme Court allowed the appeal. The Court held that genuine claims verified by the insurer's own investigator cannot be rejected on purely technical grounds when the delay is satisfactorily explained by unavoidable circumstances. The Court awarded the full claim amount of ₹7,85,000 plus ₹50,000 compensation."
