Jaipur Vidyut Vitran Nigam Ltd. and other Rajasthan electricity distribution companies (Discoms) challenged an Appellate Tribunal award requiring them to compensate Adani Power Rajasthan Ltd. for costs arising from a Coal India Limited notification imposing Evacuation Facility Charges from December 2017. The Supreme Court held that a mere difference in one party's understanding of whether a legal change has occurred does not prevent the other from claiming compensation. The Court clarified that recognition of a change in law differs from judicial interpretation of it. Once a regulatory forum adjudicates that a change in law has occurred, compensation accrues from the date of the change—not from when the supplementary bill is raised—including carrying cost at contractually specified rates. The appeal was dismissed.
