Adani Power Rajasthan Limited sought a miscellaneous application for directions on payment of Late Payment Surcharge after the Supreme Court had already finally disposed of civil appeals between the parties in August 2020. The applicant had earlier filed contempt proceedings which were disposed of in April 2022. The Court held that once an appeal is finally decided by a three-Judge Bench, the Court becomes functus officio and lacks jurisdiction to entertain post-disposal miscellaneous applications seeking substantive modifications or relief not granted in the original judgment. Such relief must be pursued through statutory channels (review or curative petitions), not miscellaneous applications. The application was dismissed with costs of Rs. 50,000.
