The Supreme Court addressed whether Maharashtra's 2019 notification extending 10% reservation for economically weaker sections in postgraduate medical courses could apply to admission processes already underway before the 103rd Constitutional amendment came into force. The Court held that existing seats cannot be subjected to the new Article 16(6) amendment without additional Medical Council sanction. Following the principle that selection modalities cannot change mid-process, the Court declared the March 2019 notification inapplicable to ongoing admissions, pending final resolution, while allowing future additional seats if sanctioned.
