In Brief
The appellant was convicted under Section 138 of the Negotiable Instruments Act, 1881 for cheque dishonour and sentenced to two years' rigorous imprisonment with a fine. On appeal, the parties presented a compromise whereby the complainant received full payment from the appellant and expressed no objection to the conviction being set aside. The Supreme Court allowed the appeal and set aside the conviction and sentence, considering the settlement, the absence of coercion, the fact that the appellant had already served 8 months and 20 days in jail, and the nature of the offence involved.
