A merchant was convicted under Section 138 of the Negotiable Instruments Act for issuing a cheque that bounced, and sentenced to three months' imprisonment plus compensation. After the High Court upheld the conviction, the Supreme Court heard his appeal. While the Court declined to disturb the concurrent findings of guilt from all three lower courts, it modified the sentence. Since the appellant had deposited the full compensation amount plus an additional Rs. 1 lakh as directed by the Court, imprisonment was waived. The additional compensation was ordered to be given to the complainant instead. Appeal partly allowed.
