Jawed Urdu Primary School Through its Secretary and Anr vs Collector of Mumbai & Ors

Bench: 2 — M.R. Shah

In Brief

A Trust running an Urdu-medium secondary school in rental premises sought allotment of a government plot reserved for primary schools. A competing society (Nasheman) also sought the land, and the government allotted it to Nasheman. The Supreme Court found that neither applicant had properly applied specifically for a primary school in the prescribed format. The Court quashed both the allotment to Nasheman and rejected the Trust's claim. It directed the land be allotted to the Municipal Corporation to establish a public primary school, serving the public interest and addressing the locality's educational needs."
