In Brief
The Supreme Court considered competing claims for allotment of a plot reserved for a primary school in Mumbai. The appellant Jawed Urdu Primary School Trust (running a school in rented premises) sought allotment; respondent No. 4 (Nasheman Welfare Society) also sought it. The Court held that neither party was entitled to the land. The appellant's applications were not specifically for a primary school and lacked proper format. Respondent No. 4 made only an informal representation without proper application and never sought recognition for a primary school. The Court quashed the allotment to respondent No. 4 as illegal. Instead, it allotted the land to the Brihanmumbai Municipal Corporation to establish a primary school, serving the larger public interest.
