In Brief
A woman married for 12 years died by suicide after allegedly being subjected to physical and mental cruelty by her husband and in-laws, including the sale of her gold ornaments (streedhan) without her consent. The accused appealed against charge-framing orders under Indian Penal Code Sections 306 (abetment of suicide) and 498A (cruelty). The Court held that while cruelty under Section 498A was established on preliminary analysis, the ingredients of Section 306 were not, as the alleged harassment occurred approximately 12 months before death, lacking the requisite proximate temporal link, deliberate incitement, and mens rea essential for abetment of suicide. The appeal was partly allowed: appellants discharged from Section 306 but to face trial for Section 498A."
