JEETENDRA S/O LATE KIRTICHAND BORADE vs THE STATE OF MADHYA PRADESH

Bench: 3 — S.A. Bobde, B.R. Gavai, Surya Kant

In Brief

Jeetendra was arrested in January 2019 on charges of forgery related to documents furnished as bail security in an earlier matrimonial case from 2008, which had been settled and he was acquitted. After over a year in custody, a police re-investigation concluded he had committed no offence. The High Court rejected his three bail applications, citing reasons including the trial court's non-acceptance of the closure report. The Supreme Court allowed his appeal, holding that bail is rule and jail is exception, and that bail cannot be mechanically rejected. It set aside the impugned order and made the interim bail absolute, releasing him on existing bail bonds.
