Jodhraj & Anr vs State of Rajasthan

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Jodhraj and another were convicted of rioting, causing injury, and theft under the IPC. The appellants challenged their convictions, while the State also appealed against the High Court's partial acquittal of one accused. The Supreme Court held that the High Court correctly doubted the credibility of the key witness and acquitted one accused on that basis. Applying the same reasoning consistently, the Court allowed the appeal, quashed the convictions under Section 302/149 IPC for all appellants, and acquitted them while dismissing the State's appeal, as evidence doubted for one accused should not support conviction of others.
