In Brief

George was convicted by the trial court and the High Court (partly) for murder and related offences under Sections 294(b), 341, and 302 IPC following the death of the informant's son during an altercation. The only evidence against George was the testimony of the deceased's father, an interested witness. However, the High Court had acquitted two co-accused for the same incident on the basis of the same witness's testimony, finding it unreliable and unnatural given the distance of the incident from the witness's location. The Supreme Court held this created a fatal logical inconsistency: the High Court could not disbelieve the witness regarding co-accused while believing him regarding George based on conjecture. The Court set aside the conviction and acquitted George of all charges.
