Joseph Easwaran Wapshare sought to uphold a Succession Certificate granted to him as the son of the deceased Gorden Wapshare. The respondent, Shirley Katheleen Wheeler (daughter of Beatrice, widow of Edward Wapshare, Gorden's brother), applied to revoke it. The Sub-Judge dismissed her application, finding she lacked standing as an outsider to the family. The High Court reversed only on res judicata grounds but remanded for reconsideration. The Supreme Court held that the respondent, having no lineal descent from Gorden Wapshare, had no legal interest in challenging the certificate. The Court set aside the High Court's judgment and restored the Sub-Judge's order, allowing the appeal.
