The Supreme Court upheld the constitutional validity of multi-member Ward representation in Indian municipalities. The Court held that Articles 243R and 243S of the Constitution do not prohibit—either expressly or impliedly—a State Legislature from prescribing multi-member constituencies. The impugned provisions of the Gujarat Provincial Municipal Corporation Act, 1949, and related rules allowing four-member Wards (with two reserved for women) do not violate Part IXA. Multi-member representation actually enhances empowerment of weaker sections by increasing reserved seats for Scheduled Castes, Scheduled Tribes, and women. The Court also found procedurally valid the government notifications concerning Ward delimitation and seat reservation.
