The State of Rajasthan issued a notification declaring Gram Panchayat Roopbas as a Municipal Board under the Rajasthan Municipalities Act, 2009. The High Court quashed it, finding no prior separate notification under Article 243Q(2) of the Constitution specifying it as a "transitional area." The Supreme Court reversed this, holding that the State Legislature has full power to legislate on municipalities within its competence. Part IXA of the Constitution does not require two separate notifications; a single notification establishing the Municipality under the State statute suffices if not inconsistent with Part IXA. The Court clarified that the power to constitute municipalities is legislative, not amenable to arbitrariness challenges absent statutory non-compliance.
