Supreme Court of India 2024-11-27

Bench: 2 — J.B. Pardiwala, R. Mahadevan

In Brief

A woman challenged the High Court's decision to grant bail to an accused charged with rape and wrongful imprisonment. Although no trial commencement discrepancies were found between the FIR and the victim's statement alone do not justify bail in serious crimes like rape. The Supreme Court upheld the bail but imposed strict conditions: the accused cannot enter the victim's village until trial ends, must not contact witnesses, and the trial should conclude within three months. The Court clarified its observations were preliminary and not final opinions on guilt, reaffirming that bail should rarely be granted in rape cases once prosecution witnesses begin testifying."
