In Brief

Five advocates were appointed as Additional District and Sessions Judges in Fast Track Courts in Tamil Nadu (2002–2010/2012) on ad-hoc basis. After relief, they sought pension, gratuity, and leave encashment. The High Court rejected their claims, holding the Fast Track Courts were not a pensionable establishment and appointments were contractual. The Supreme Court reversed this, finding the Fast Track appointments were against sanctioned judicial posts on the pensionable establishment. The Court held all appellants entitled to pension (superannuation if retired at age 60, compensation if post abolished), gratuity, and earned leave encashment within statutory limits, to be paid within two months plus 7% simple interest if delayed.
