A widow and two minor children of a 32-year-old Senior Design Engineer sought compensation after his death in a car-lorry collision on a highway. The Tribunal and High Court found both drivers equally negligent and awarded only 50% of the assessed compensation. The Supreme Court reversed the finding of contributory negligence, holding that the lorry driver's illegal parking without signals wholly caused the accident. The Court also raised the future prospects addition from 10% to 50%, increasing total compensation from Rs.17,34,156 to Rs.50,89,960 with 9% interest from petition date.
