K.C. LAXMANA vs K.C. CHANDRAPPA GOWDA & ANR

Bench: 2 — S. Abdul Nazeer, Krishna Murari

In Brief

K.C. Laxman (second defendant and appellant) challenged a High Court judgment upholding the nullification of a gift deed he received from the plaintiff's father. The dispute involved whether a gift of ancestral joint family property made "out of love and affection" to a non-family member was valid under Hindu Mitakshara law. The Court held that such a gift is void unless made for a "pious purpose" (charitable or religious purposes only). The Court also found the suit was not time-barred under Article 109 of the Limitation Act (12-year period from possession), not the 3-year period. The appeal was dismissed, upholding the gift deed's nullification.
