K.K. Suresh & Anr. etc vs Food Corporation of India & Ors. etc

Bench: 2 — Abhay Manohar Sapre

In Brief

Appellants working as clerical staff sought regularization of their services as permanent employees of the Food Corporation of India (FCI). They had been working since 1997 but were actually appointed by the FCI Head Load Workers Co-Operative Society, not by FCI directly. The High Court and Supreme Court held that without an employer-employee relationship with FCI, regularization could not be granted. The appellants failed to produce evidence of direct appointment by FCI. The Court dismissed their appeals, holding that their remedy, if any, lay against the Co-Operative Society, their actual employer, not against FCI."
