The Supreme Court upheld a Madras High Court judgment dismissing challenges to the Union of India's nomination of three members to the Puducherry Legislative Assembly in 2017, while deleting the High Court's recommendations. The Court held that "Central Government" under Section 3(3) means the President (not the Administrator), that nominating members is not the Government of Puducherry's business, that no constitutional convention requires prior consultation with the State government, and that nominated members have full voting rights on all matters including budgets and no-confidence motions. The only modification was deletion of the High Court's recommendations regarding nomination procedures.
