K. Lubna & Others appealed against a High Court order that partially rejected an eviction claim under the Kerala Buildings (Lease and Rent Control) Act, 1965. The trial court found no bona fide need for two rooms and that sub-letting was not proved for two rooms, but was proved for one room. The High Court sustained eviction only for the room where sub-letting was established. The appellants contended that proof of sub-letting in part of the premises entitles eviction of the entire tenancy. The Supreme Court examined whether partial sub-tenancy justifies full eviction where a single notice sought eviction on different grounds for different rooms."
